President Netumbo Nandi-Ndaitwah on Thursday reaffirmed the independence of Namibia’s judiciary, warning that any perception of political influence over court decisions would pose a threat to the country’s democracy.
Nandi-Ndaitwah made the remarks at the opening of the 2026 legal year, stressing that the courts had remained steadfast despite operational challenges.
She described the judiciary as a co-equal arm of the state that must function without fear, favour or prejudice, while contributing to national development and strengthening public confidence in governance.
“The judiciary stands as the moral and constitutional compass of our democracy,” she said.
Nandi-Ndaitwah further noted that judicial independence is a constitutional obligation owed to the people, not a privilege granted by the government.
She maintained that a strong and effective court system underpins economic growth, social stability and accountability, adding that a weakened rule of law creates space for corruption, crime and impunity.
The president also emphasised that the courts must ensure accountability for crimes while maintaining equal access to justice for citizens and visitors alike.
Turning to case backlogs, Nandi-Ndaitwah said prolonged delays, particularly in matters involving public resources, undermine public trust and national development.
She called on all stakeholders in the legal fraternity to work together to address the problem and deliver justice within reasonable timeframes.
The president reaffirmed the executive’s commitment to supporting the judiciary through improved resources, infrastructure and alternative dispute resolution mechanisms, while respecting the separation of powers.
