Intern medical doctor Dennis Noa has told the Ondangwa Magistrate’s Court that he gave the man (26) he is accused of raping diazepam after they ate, drank and had “consensual” sex.
Noa said this while testifying during his bail application in connection with an alleged rape on 18 July.
He told the court last week that diazepam was medication used for insomnia, high blood pressure and anxiety.
According to Noa, the complainant had contacted him to arrange a visit to celebrate his first salary after securing a new job.
Noa said the complainant gave him a missed call on 15 July, prompting him to return the call.
During the conversation, the complainant allegedly said he wanted to visit Noa’s residence so they could celebrate his new job.
He said he contacted the complainant again on 17 July at around 14h30 to confirm whether he was still coming.
The complainant later called him and said he was on his way, but did not have transport money.
“I offered to pay for his taxi,” Noa told the court.
Noa further testified that by 17 July, the two had communicated by phone 102 times.
He said he bought six cans of draught beer because the complainant enjoyed beer, and added that he had vodka at home.
According to his account, the two shared food and alcohol before engaging in what he described as consensual sex.
“He then asked me to give him my medication. I gave him diazepam,” Noa testified.
His testimony was cut short after his lawyer told the court they could not continue because Noa was unwell and needed medical attention.
The lawyer said they were unable to comment in the absence of their principal, Bianca Boois.
The matter was postponed to Monday for the fixing of a new date for a formal bail application.
Noa is accused of drugging the complainant, allegations he has denied.
It is alleged that after consuming the substance, the complainant became nauseous and was sexually assaulted.
The complainant allegedly escaped by breaking a window after discovering that the room was locked, before later regaining consciousness in a hospital bed.
The latest charge comes less than two years after the High Court overturned Noa’s conviction in an unrelated rape case involving a male patient at Katutura Hospital.
Noa had been convicted and sentenced to eight years’ imprisonment after being found guilty of raping an unconscious patient in April 2021.
However, in November 2024, the High Court set aside the conviction after finding that the State had failed to prove the charges beyond a reasonable doubt.
