Redforce Debt Management has once again emerged victorious in a legal battle against the Henties Bay Municipality over a disputed $60-million tender, effectively returning it to work after months of court fights.
This follows an urgent application filed by Redforce on 25 October 2024, which was heard on 5 November 2024, challenging the municipality’s decision to annul the tender.
In response, the Henties Bay Municipality lodged a counter-application on the same day, seeking to have the contract with Redforce set aside.
The municipality, represented by its acting chief executive, argued that the contract was signed beyond the legally prescribed 30-day period, thereby rendering it invalid under the Procurement Act.
However, in its ruling, the High Court dismissed the municipality’s counter-application.
“The counter application was removed from the roll as the judge opined that it could be heard as part of the main application,” ruled acting judge Doris Hans-Kaumbi.
Additionally, the court denied the municipality’s request for leave to appeal to the Supreme Court and ordered it to cover Redforce’s legal costs, including those for both instructing and instructed counsel.
Redforce chief executive Julius Nyamazana has since confirmed that the company has resumed operations at Henties Bay.
Redforce was initially awarded the contract in January 2022 to recover outstanding municipal rates and taxes, successfully collecting over N$43 million between February 2022 and September 2024.
This latest legal victory adds to a growing list of cases in which Redforce has successfully defended its municipal contracts across Namibia with latest being with the Walvis Bay municipality.
