New bill proposes executive director, deputy for ombudsman’s office

The Ombudsman bill recently tabled in the National Assembly, if passed, would ensure the Office of the Ombudsman has an executive director, deputy ombudsman and provisional staff.

The bill, tabled by justice minister Yvonne Dausab, proposes making the office an independent body with more authority to hold public institutions accountable.

If passed, in accordance with the Public Service Act, the prime minister would be required to appoint an executive director for the office, as well as other staff members as may be required for the proper performance of the functions.

The executive director would also be the accounting officer as stipulated in section 8 of the State Finance Act, making them responsible for the day-to-day administration and efficient management of the office. The ombudsman and deputy ombudsman would be appointed by the president on the recommendation of the Judicial Service Commission.

“The ombudsman may not perform or commit himself or herself to perform remunerative work outside his or her official duties; or receive any remuneration for work performed outside his or her official duties,” reads the bill.

The bill further states that the functions of the ombudsman are to investigate and enquire into any instance or matter, on his or her own accord or on request by any person or complaint lodged with his or her office. Specifically, the bills states that the Office of the Ombudsman must investigate complaints concerning children or any violation of children’s human rights.
