The Electoral Commission of Namibia (ECN) is claiming that the Electoral Court does not have jurisdiction to hear an urgent application brought by the Namibia Economic Freedom Fighters (NEFF), which is challenging its deregistration by the ECN.
This is disclosed in a notice by the ECN that has been sent to the registrar of the court and lawyer Kadhila Amoomo, who is representing the NEFF.
“The honourable court does not have jurisdiction to hear this matter on the basis that the review application underpinning the urgent relief does not raise an electoral issue as contemplated in section 168(1)(e) of the Electoral Act, and that this section is only available for review relief relating to any electoral issue,” says the ECN in the notice.
The NEFF was deregistered last month, following accusations that it failed to publish its audited financial statements as required by law.
