Matter of fact: ACC claims Namcor fuel deal is ‘fraud on paper’

Yesterday, The Namibian published a report titled “ACC claims Namcor fuel deal is ‘fraud on paper’”. In the report, it was stated that defence lawyer Sisa Namandje argued that directors of companies cannot be arrested for the crimes of their companies. Namandje, in fact, said for the state to seek a director of a company to be personally prosecuted for crimes committed in his/her capacity as director, it must rely on Section 332(5) of the Criminal Procedure Act. He was showing investigating officer Oberty Inambao that the state strangely does not rely on Section 332(5) on some charges. The Namibian apologises and regrets the error.
