THE motion court roll was dominated this week by First National Bank which moved in on vehicle owners not honouring instalment sale agreements made with the financial institution. Standard Bank, usually dominant in all money matters, appears to have cleared a lot of its debt book focusing primarily on defaulters on home loans. Bank Windhoek did not feature. Private matters too declined, forecasting the slowing of motion matters towards the end of the year.

Loans Reclaimed:First National Bank: A total of 11 default judgments of which eight were for instalment sale agreements. Value: N$441 135.68. Standard Bank: A total of four default judgments of which two files held two claims and one judgment for an instalment sale agreement. Value: N$139 703.31.Nedbank: One default judgment in respect of an instalment sale agreement the value of which was N$21 312.34.Homes Reclaimed:Standard Bank: Against Erwin Ulrich Awoseb and Cecilie Belinda Awoses, default judgment in the sum of N$76 546.01, Holding 132 in Okuryangava, declared executable. Default judgment of N$24 402.22 against Shaun Charl Wentworth, address given as Holding 803, a portion of Holding 313 in Dorado Park Windhoek, which property was foreclosed.Holding 3667 in Ongwºediva’s Extension 7, foreclosed by means of a default judgment in the sum of N$319 548.11, against Pieter Johannes Botha.Against Georgina Ebenhardine Hjata, default judgment of N$332 814.93, her home, Section 41 in City Heights, Windhoek, declared executable.Default judgment to the value of N$396 141.31 against Doreen Yvette and Azalia Bezuidenhout, Section 4, Madawas Haven in Khomasdal, foreclosed.Each matter bore costs and annual interest.First National Bank:Default judgment in the sum of N$567 583.45 against Charles George van Wyk of Holding 2753 in Extension 8, Walvis Bay, the property declared executable.Against Patricia Kachana Salushando, default judgment of N$75 180.55 with foreclosure on Holding 865 in the third extension of Katima Mulilo.In both matters, the bank was awarded annual interest and costs.Nedbank:One default judgment against Daniel Jacobus Theunissen of Holding 40 in Stampriet, the judgment in the sum of N$21 178.87 and the property foreclosed. Annual interest and costs were awarded the bank.__________Capital Press (Pty) LimitedBeleaguered Capital Press featured in the motion roll of the past week with First National Bank asking for the restoration of a Fiat Doblo Cargo vehicle with all payments made towards the loan, forfeited to the bank. They further asked the court to grant them leave to apply for a judgment in the event of any damages as well as payment of N$108 430.43 if the car is not restored. The bank asked for, as was awarded, an astounding interest rate of prime plus 10 per cent. The default judgment was issued against Capital Press, Andre Francois September, Garoy Nico September, Deon Anthony September and Ralph Paul September.Slabbert Burger TransportH. Lambert Transport, place of business at 4 Kort Street in Otjiwarongo, default judgment of N$178 700.86 dollars against Slabbert Burger Transport Namibia (Pty) Limited, trading from 11 Gold Street in Prosperita. In the papers, the plaintiff said that he had reached an oral agreement for the transport of goods in the north of the country for the defendant. The latter however, had not paid for the services. Interest and costs were awarded.Etunda Irrigation ProjectA judgment in the sum of N$1 546 103.80 was granted to PBD Boeredienste (Pty) Limited, trading as Greelands Fertiliser, trading at Michelin Street in Van Der Bijl Park in South Africa, against Etunda Surikate (sic) Investments CC, trading as Etunda Irrigation Project in Grootfontein. The money owed for goods sold and delivered. Costs and interest of 20 per cent per annum were granted.Engineering Innovations CCWindhoek Tool Centre CC, address given as Simmentaler Street in the Northern Industrial Area, default judgment of N$71 056.72 against Engineering Innovations CC, trading from 32 Hendrik Hop Street in Suiderhof, Windhoek. The money owed for goods sold and delivered. Tool Centre asked for annual interest of 20 per cent a tempore morae as well as costs. The order was granted as prayed.NO ESCAPING THE LONG ARM OF THE LAWTitus Ipumbu Legal Practitioners applied for, and obtained a default judgment against Lazarus Natangwe Shaduka, currently incarcerated at Windhoek Central Prison, in the sum of N$29 758.46 for legal services rendered. Annual interest of 20 per cent and costs were awarded.
