Court orders businessman to pay N$130 000

An OSHAKATI businessman, Niklas “Tuuto” Ndafediva, was ordered by the High Court in Oshakati to pay N$130 000 after he defrauded fellow businessman, Corneluis Nauyoma.
Nauyoma bought an Iveco bus, for N$170 000 from Ndafediva on 8 June 2009.
The bus was, however, confiscated on 21 November 2009 by Jan Liebenberg, a messenger of a commercial bank, while Nauyoma was transporting passengers to Ondangwa.
Nauyoma told The Namibian that Ndafediva had sold him the bus before he had settled the bank loan he [Ndafediva] had initially taken to buy the bus and had been refusing to repay him the N$170 000. Since the bus had originally been purchased with a Nedbank loan, Liebenberg told Nauyoma that the bus belonged to the bank when he impounded it.
On Tuesday this week both parties appeared in the High Court in Oshakati to sign an IOU settlement agreement and Ndafediva was ordered to pay N$3 000 on that day and then settle the re-evaluated balance of N$127 000 in instalments of N$5 000 per month. Nauyoma was represented by Hanna Visser and Ndafediva was represented by Mbushandje Ntinda of the law firm Sisa Namandje & Co.
