Young men await gang-rape trial verdict
Werner Menges
FOUR young men accused of gang-raping a fellow student at Okakarara five years ago are due to hear the verdict in their trial in the Windhoek High Court on Thursday next week.
The judgement in the trial of the four, who are facing multiple counts of rape, was scheduled to be delivered by Judge Nate Ndauendapo yesterday, but was postponed for a week after the judge indicated that he has not been able to complete his judgement yet.
The four accused were all still juveniles when the crimes they are accused of were allegedly committed. They have pleaded not guilty to all charges against them.
They are all alleged to have raped a 15-year-old girl at Okakarara on 23 May 2008.
Two of the accused, who were 15 and 16 years old respectively at the time of the alleged incident, are facing six counts of rape each. The other two accused, who were both 16 at the time, are charged with four counts of rape each.
The prosecution is alleging that two of the accused dragged the complainant, who was a classmate of theirs, to a toilet where they closed the door and took turns raping her.
It is further alleged that the third accused later threatened the complainant with a knife and forced her to accompany him to a school hostel. At the hostel, each of the four accused raped the girl, while the others assisted the perpetrators, the prosecution is alleging.
Each of the accused is charged with a count of rape for having allegedly raped the girl himself, and also with additional charges of rape for having allegedly assisted his three co-accused to rape her.
Two of the accused admitted during the trial that they had intercourse with the complainant, but claimed that they did that with her consent. The other two denied flat-out having committed any of the alleged crimes.
