Assaulter wants job back

   This is unbelievable! A man assaulted his manageress and they are supporting him to get his job back. Who wants to / can work with someone that assaulted you? How can you even support such case? He smelt of alcohol and got aggressive and now some people comment that "maybe he just had a bad day". Unbelievable that is all I can say! - lucy

   I am not supporting Shipanga to go back to work. He is one of the men in Namibia who are abusing women in this country. He does not respect the law . This is the Namibian independence country . He does not have the right to abuse and violent the human right law. Shipanga should go back to his home and learn to respect people ecpecial women. Point number one he was drunk during working hours and abuse his supervisor. What kind of a mess is that one. What kind of union is that one?, that is protecting the Shipanga the women abuser? You guys from the union go back and read the Namibian 's human right constitution and come back to tell us the content of it.    Theft is an offence of dishonest, even if N$10. He was just a better employee but when he steal more especial from client he deserve to be fired at all cost. If I was the employer I would call back the butcher back serve him with suspension and fire him right away, retain all monies due to him and while at the same time suing him for any loss incurred as well as medical fees.    Whether the guy worked for 18 years is irrelevant! Did you see that woman's face? My goodness! This is not even a matter of debate! He comes drunk to work, steals from a client and then beats up the manager. Any one of those 3 offences are reasonable grounds for dismissal. There's just nothing this guy can say to justify his actions. If he had a problem with the manager then he should've discussed it with her or with the owner in a civilized manner.    This is very funny,, The guy work for 18yrs and all of the sudden he got fired because of 10 bucks that he has been accuse of. This Holloway guy, if this employee work for him for 18 yrs then he should know better by know that he is one of the most trusted employee that has work for him. And this Moolmann women why didn't she test all the employees in the morning when they report for duty, It is clear as daylight that she failed to act as a manager . This employee is not stupid to just get up a bunch a women in the face, there has to be a reason from point of view she either insulted him or was racist , It could also be that she acted out of jealous of the guy working for 18 yrs at the Stiltz .    The Manager correctly pressed charges for assault and the employer wrongly fired Shipanga without having been found guilty by a diciplinary committe. NAFAU must ensure that an members are treated fairly by employers, irrespective of who was involved(man or woman) - MULUNGA

   I think no one can suport violence against any one,but the bone of contention here is the fact if displinary healing was not in line with the labour act and in this case climinal charges would have been laid but not both by dismissing and laying charges aginst the duo.breather lyser is also not justified in terms of our consititution and the court could not proove to us if the said results were made visible to any police oficer who made the arests in order to subsintiate the charges aginst the employee.this a miscaridge of justice if this is what is hapening and left unchallenged. - Phillip Munenguni

   I think irrespective of the money that was lost or the time the suspect worked at the place he should at least have respect for a woman and him being a bar man drinking on duty is already and offence if it is true and why did the supervisor conduct the test without a witness because its the suspects word against hers coz without any evidence they cant really get rid of a person without any evidence ,but he deserves to be punished for the assault so that he doesn't repeat it again woman and children are not punching bags they are our mothers and children Mr. Shipanga the union is confused really they should learn to prioritize situations and not act based on what they think is right. - Anonymous

   @Hilma Negonga, i totally disagree with you, you cannot dismiss someone from the word go without giving him a fair chance to explain himself or herself, that amount to a summary dismissal. a corrective measure would have been taken against this guy, to demote him, take him for anger management program or transfer him to a different department, this are all good alternatives instead of summary dismissal. he worked for 18 years, to send him back to the street given this unemployement rate is absurdity and not in the interest of society. - Ngunovandu Mwatje

   I think no one shld support violence against women, but then at the same dismissal shld be according to procedures as laid out by the labour Act. i believe the reason why the court suspended his sentence was because of the mitigating factors which included his work and family support foremost. similar the employer in my opionion would have seeked for one recourse only, either to dismiss or lay a criminal charge only - but to go for both redress amounts to unfair dismissal which is contrary to the Labour Act, 2012. - King Martin
