Naftalie Kondja (27), Matti Kamati (36) and Temus Natangwe Shiwalo (32) will have to return to court on February 16 for a second pre-trial hearing to sort out arrangements for their legal representation, they were told by Judge Louis Muller.

Kondja told the Judge that he had applied to the Directorate of Legal Aid for legal representation, but that he had not yet received an answer.

Kamati and Shiwalo told the court that they planned to represent themselves.

Kondja is the only one of the trio to remain in custody pending the trial.

Kamati and Shiwalo have been released on bail.

They have had to report to the Police three times each day as part of their bail conditions, but at their request Judge Muller changed this to twice a day.

They may still not leave the Swakopmund district without the permission of the Police officer in charge of the investigation, the Judge reminded them.

The murder and armed robbery sparked public outrage at Swakopmund in August 2004.

Goldsmith Alexandra Mooren (44) was taking what was supposed to be a peaceful stroll on the beach on the morning of August 12 2004 when, it is alleged, Kondja attacked her.

He is accused of shooting her twice with a .22 revolver that had been stolen out of a parked car at Swakopmund the previous day.

He allegedly fled from the scene after grabbing Mooren's handbag.

According to the charge sheet, Kondja then handed the handbag to either Kamati or Shiwalo, or to both.

It is also alleged that when Kondja was arrested later that day, the murder weapon was found in his possession.

The prosecution alleges that Kondja, Kamati and taxi driver Shiwalo, who is claimed to have given Kamati a ride to help him get away from the crime scene, acted with a common purpose.

Each of the three is set to face charges of murder and robbery with aggravating circumstances.

They will also stand trial on a charge of theft in connection with the theft of the .22 revolver, valued at N$2 000, and a video camera valued at N$6 000 out of a car on the day before the shooting.

Kondja alone will further face additional charges of possessing a firearm without a licence and negligent handling of a firearm.
